This Privacy Policy outlines the manner in which we process Personal Information about persons who use our Services, including the information we collect, the purposes of collection, how we use, share and protect it, as well as your rights with respect to your Personal Information. For definitions of the terms used in this Policy please see Section 2 below. You will be asked to explicitly accept this Policy when you sign-up for our Services. Please note that this Policy may be updated from time to time, as described in Section 14.
This Policy is incorporated by reference into the Terms and Conditions.
Our Services are provided as part of the open and regulated internet gaming (igaming) market in Ontario conducted and managed by iGaming Ontario. In the course of and in connection to, providing our Services, we collect, use, and disclose information: a) on behalf of and as agent of the iGaming Ontario; b) under the legal authority under the Ontario Regulation 722/21 made under the Alcohol and Gaming Commission, and the operating agreement entered into between us and iGaming Ontario; c) pursuant to the applicable Privacy Laws.
WE ENCOURAGE YOU TO READ THE POLICY CAREFULLY AND USE IT TO MAKE INFORMED DECISIONS. BY CONTINUING TO USE OUR SERVICES YOU CONFIRM THAT YOU HAVE READ THIS POLICY AND EXPRESSLY CONSENT TO OUR COLLECTION, PROCESSING, USE, AND DISCLOSURE OF YOUR PERSONAL INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY AND OUR TERMS AND CONDITIONS. IF YOU DO NOT AGREE WITH THE TERMS OF THIS POLICY OR THE TERMS AND CONDITIONS, YOU MUST IMMEDIATELY STOP USING OUR SERVICES.
We are responsible to ensure that the Personal Information you provide to us remains accurate and up-to-date. You are responsible to inform us in case of any change or update of the Personal Information you have provided us.
While we rely on your consent for collection, use, and disclosure of your Personal Information, for a certain portion of your Personal Information we also perform these activities as required to meet our legal, regulatory and/or contractual obligations; these include our obligations under iGaming laws, Anti-Money Laundering laws, other Applicable Laws, and our operating agreement with iGaming Ontario.
Definitions
“Applicable Laws”
refers to any domestic, foreign or international law, statute, ordinance, regulation, by-law, standard or other binding instrument, as updated from time to time, in force in the Province of Ontario or otherwise binding on the person being referred to in the context where the term is used;
“FIPPA”
refers to Ontario’s Freedom of Information and Protection of Privacy Act, R.S.O. 1990, c. F.31;
“iGaming Ontario”
refers to the corporation established under the O. Reg. 517/21: Lottery Subsidiary - iGaming Ontario;
“Personal Information”
refers to information that identifies or may reasonably identify an individual with reasonable effort , as defined in the Privacy Laws;
“PIPEDA”
refers to the Canadian (Federal) Personal Information Protection and Electronic Documents Act, S.C. 2000, c. 5;
“Policy”
refers to this Privacy Policy;
“Privacy Laws”
refers to the Applicable Laws that govern collection, use, disclosure and retention of Personal Information, including the PIPEDA and FIPPA;
“Services”
refers to the Website, including the mobile version where applicable, its content and digital assets, and all access and services provided therein;
“us”, “we”, “our” and similar
refers to the operator of the Services – Canadix Limited, a company under the laws of Malta, with its registered address at Quad Central, Q3 Level 3, X, Zone 1, triq L-Esportaturi, Central business District, Birkirkara, CBD 1040, Malta.
“Website”

Information we collect about you
We collect and use the following types of Personal Information about you:
Registration/Login
We may ask you to provide us with certain Personal Information about yourself, during the account registration and thereafter, the information provided shall be used for your registration, identification and for account management by us.
This information may include your full name, residence and mailing addresses, telephone/cell number, email address, date of birth, photograph, gender, occupation, marital status, hobbies, utility bills and any other mandatory details as might be requested at any and all time from you for the purpose of registration and/or continued use of the service.
In addition, we may collect certain information as required under various gambling regulations, as well as Know Your Client (“KYC”) and Anti-Money Laundering (“AML”) regulatory requirements, such as your source of funds. The said data are processed in order for us to perform its contractual obligation with its users and pursuant to our legitimate interests. By providing such Personal Information to us, you warrant that it is full, accurate and up-to-date.
Governmental-issued ID:
In certain instances, you may be required to provide a copy of a governmental-issued ID, for identity verification process. Please note that this information is required for certain features of our Services.
Payment Processing
Any provided account, credit card or other information regarding payment transactions will be collected and may be transmitted to the payment service provider, in order to fulfill the payment requested by you. Additional terms and conditions of the payment providers may apply, which should be available in the transaction process.
Player behaviour:
We also collect information regarding potential gambling problems or addictions, based on your patterns of gambling across our services, in order to ensure a responsible gaming environment and as required by law.
Device information
Our Services may collect additional Personal Information about you when you use those Services. Such collections are automated and usually seamless. Personal Information collected in this manner may include:
- online identifiers, such as IP address;
- information about your software and hardware, such as your operating system and software you use to connect to the Services, your MAC address, radio frequency identification (“RFID”), device identifier ("UDID") hardware serial number, Wi-Fi information and similar;
- location data, which includes your physical location when you use our Services, based on your Internet connection data, GPS data, and similar;
- advertising identifiers, which differentiate you from other Internet users in various advertising networks;
Log-in history and technical information:
In order to enhance the functionality of the Services and to provide you with a better user experience, we collect technical information transmitted by your device, including certain software and hardware information (e.g. the type of browser and operating system your device uses, language preference, access time and the domain name of the website from which you linked to the Services; etc.).
Gameplay information
We record game play information including, amongst other things all your deposits, withdrawals, gaming transactions (such as bets and wins) and other transactions within the Services, the tools and services you use to perform those transactions.
Analytics information
We collect information about your use of the Services, which includes information such as application's usage, log files, user activity (e.g, pages visited, clicks, online browsing, time spent), alerts and your other actions on the Website. This information is collected for amongst other things troubleshooting errors and bugs as well as for research and analytics purposes about your use of the Service.
Voluntary information
We also collect information about yourself that you provide us voluntarily at your discretion in order to personalize your account or for a specific function.
Live Chat/Support/Contact Form
We monitor and/or record your conversations with us and retain the recordings for such periods as may be necessary to handle your inquiries for customer support and/or security purposes, or as may be required by law and/or in our best interest.
Cookies and similar technologies.
We use cookies and similar technologies within our Services. These are used to help you navigate the Services, remember your choices, automatically fill-in information for you, but also track you and collect data on your usage of the Services. Please see Section 10 for more details.
Personal Information we receive from third parties and open sources:
We may receive Personal Information about you from various third parties engaged in operation of our Services and from our partners. These may include:
- Identity verification or “know your customer” (KYC) service providers, credit rating agencies, transaction verification service providers, anti-fraud and cybersecurity services providers;
- Banks, financial institutions, and payment providers that you use to finance you account with us;
- Third parties that provide content delivered to you as a part of our Services (e.g. providers of games and odds);
- iGaming Ontario;
- Provincial and federal agencies;
- Our marketing partners/ affiliates and advertising agencies;
- Other third parties engaged in provision of our Services;
- Our corporate affiliates – companies that are members of the same corporate group as ourselves.
We may also collect Personal Information from publicly available sources such as web searches, company registers, social media, news agencies and mass media, provided it is reasonable to do so, and such conduct is not detrimental to your rights and freedoms.
Collated and derived Personal Information:
We may collate and compile Personal Information about you that we receive from you and from other sources. We may derive Personal Information about you from the information in our possession. This is done for internal purposes and to administer your Services. Such information may include various scores, ratings and profiles, in particular for risk and responsible gaming assessments.
By accepting this Policy, you warrant that you will not attempt to falsify, obscure, or alter any information we collect in this manner (for example, by using a VPN).
How we use information about you
We use your Personal Information for the following purposes:
Non-Marketing purposes.
We may use your Personal Information for non-marketing purposes, which include:
Provision of our Services; support and customer relations
We collect and use your Personal Information, such as your name and email address, for consumer services purposes. This includes, for example:
- Setting up, managing and updating your account;
- Providing and administering our Services, including purposes ancillary to the Services provision;
- Tracking and processing financial and gaming transactions;
- Providing you with service and transaction-related notices and updates of non-marketing nature, answering your queries;
- Providing customer support services.
Improving our Services
We collect, use and disclose information about you and your usage of our Services in order to analyse such usage to improve the usability and effectiveness of our Services. This includes, for example:
- Monitoring, measuring, and improving our Services;
- Conducting analytics, statistical and research purposes, in order to improve and customize the Services to your needs and interests (such as by compiling aggregated reports about the usage of certain features of our Services);
- Providing technical support, diagnosing and fixing technical issues with our Services;
- Customizing our Services, remembering your choices and information you’ve entered, providing you with specific offers;
- Operating our loyalty programs and promotional offers.
Compliance with applicable laws
We collect, use and disclose your Personal Information to comply with our various legal obligations, including without limitation obligations relating to responsible gaming, anti-money laundering, identity verification, prevention of fraud and complying with data subject rights. This includes, for example:
- Managing and monitoring our ongoing relationship with you;
- Meeting our legal and regulatory obligations;
- Meeting our contractual obligations towards iGaming Ontario;
- Verifying your identity and performing other KYC procedures;
- Providing a safe and secure environment and facilitating responsible gambling.
Prevention of fraud
We may collect, use and disclose your Personal Information to detect and prevent fraudulent and illegal activity or any other type of activity that may jeopardize or negatively affect the integrity of the Services. This includes, for example:
- Identifying risks associated with your activity on our Services;
- Performing actions aimed at preventing fraud and illegal activity;
- Investigating potential breaches of our Terms and Conditions and applicable rules;
- Analyzing and preventing fraudulent and illegal activity or any other type of activity that may jeopardize or negatively affect the integrity of the Services, including by identifying risk related to anti-money laundering, terrorist financing, and fraud.
Corporate transactions
We may disclose your Personal Information to potential purchasers, successors or investors in our company or any other member(s) of our company's group or in the event of a corporate transaction (e.g. sale of a substantial part of our business, merger, reorganization, bankruptcy, consolidation or asset sale of an asset or transfer in the operation thereof) in relation to us or any other member(s) of the our company's group.
Dispute resolution and protection of our legal claims
We collect, use and disclose your Personal Information in order to investigate and resolve disputes and legal claims. This includes, for example:
- Processing and acting upon your complaints;
- Resolving disputes in connection with your use of the Services;
- Establishing legal claims;
- Protecting ourselves against legal actions and claims.
Marketing purposes.
In accordance with your consent, we use the Personal Information you have given us to deliver tailored advertising and pertinent marketing material, to market our Services and to gather aggregate usage information and analytics. You may choose to sign-up to receive marketing communication from us, either during the account registration process or thereafter. If you choose to sign-up to such communication, we may process your Personal Information to send you special promotions, offers, and other notifications of marketing nature, provide targeted advertising via SMS, telephone, e-mail, push notifications, and other means. We may also combine information from various sources and use your Personal Information for profiling purposes, to build your profile as our customer and provide you with personalized offers. You may opt-out from this marketing communication by clicking on the unsubscribe link inside our messages or by contacting us at support@tooniebet.ca. Please note that even if you unsubscribe from our marketing mailing list, we may continue to send you service-related updates and notifications.
We may also share and disclose your Personal Information with our other companies within our group or our group's business partners and affiliates ("Marketing Affiliates"), for the purpose of providing you with different marketing offers, which we, or our Marketing Affiliates, believe are relevant for you. Our Marketing Affiliates may use this Personal Information for different marketing techniques, such as direct email, post, SMS and telephone marketing purposes.
Please note: you can control the delivery of certain advertising or social campaigns through the settings offered by the respective third party platforms (e.g. Facebook).
In addition, if you download any of our mobile applications to your device from the Apple AppStore or Google Play, the only way to prevent receipt of notifications is by changing the settings on the device itself.
We use third-party advertising technology to serve advertisements when you visit our Website and use the Services. You may opt-out of many third-party ad networks, including those operated by members of the Network Advertising Initiative ("NAI") and the Digital Advertising Alliance ("DAA").

Conditions for processing your personal information
In accordance with FIPPA (s.38. (2)), we have the authority to collect and process Personal Information under these conditions:
- The collection of Personal Information is expressly authorized by a law or statute;
- The information collected is used for the purposes of law enforcement; or
- The information collected is necessary for the proper administration of a lawfully authorized activity.
In addition, we collect, use or disclose your Personal Information under these conditions:
- You have specifically given us your informed and explicit consent in writing to the collection and processing, or disclosure of such Personal Information (FIPPA s.39. (1) and 41.(1));
- The information collected, used or disclosed is for the purposes of complying with other laws (FIPPA s.41.(1) and s.42.(1));
- The information collected, used or disclosed is needed and necessary for the performance of our duties (FIPPA s.41.(1) and s.42.(1));
- The information collected, used or disclosed is for the purposes of law enforcement;
- Any other situations permitted under FIPPA or Applicable Laws.
We have set out in Section A above a description of the purposes for which we may use your Personal Information.
How we share information about you
We will never rent, sell or share your Personal Information with third parties ("Recipients"), and we disclose your Personal Information to Recipients only to the extent required for one or more of the specific purposes stipulated in this Policy.
Sharing Personal Information for non-marketing purposes.
We may share your Personal Information with third parties that are engaged in delivering our Services and pursuing other purposes listed in Section 4(A) above, and that need it to perform their contractual obligations towards us, as well as to meet their own legal and regulatory obligations. These Recipients include:
- Identity verification or “know your customer” (KYC) service providers, credit rating agencies, transaction verification service providers, anti-fraud and cybersecurity services providers;
- Banks, financial institutions and payment providers;
- Third parties that provide content delivered to you as a part of our Services (e.g. providers of games and odds);
- iGaming Ontario;
- Our marketing partners and advertising agencies;
- Auditors, contractors or legal/financial/other advisers;
- Responsible gaming/ gambling addiction bodies;
- Any third parties who organize offline events or tournaments on behalf of or in conjunction with us or within our group;
- Potential purchasers, successors or investors in any of the companies within our group, or in the event of a corporate transaction (e.g. sale of a substantial part of our business, merger, reorganization, bankruptcy, consolidation or asset sale of an asset or transfer in the operation thereof) in relation to any company within our group (in such event, the acquiring company or transferee will assume the rights and obligations as described in this Policy);
- Other third parties engaged in provision of our Services;
- Our corporate affiliates – companies that are members of the same corporate group as ourselves.
Sharing Personal Information for marketing purposes
We may engage third parties to pursue marketing purposes listed in Section 4(A) above, and in such case we may share your Personal Information with such entities, where you have consented to the disclosure of your Personal Information for these purposes. You may opt-out from us sharing your Personal Information in this way by opting out from our marketing communication, which may be done by clicking on the unsubscribe link inside those messages or by contacting us at support@tooniebet.ca.
Compelled disclosure
We may disclose your Personal Information to federal and provincial governmental institutions, licensing authorities and other entities as required by the Applicable Laws. In particular, we will cooperate with law enforcement agencies for purposes of national security and public safety.
In addition to the purposes listed in this Policy, we may disclose Personal Information with those Recipients for any of the following purposes:
- Storing such information on our behalf, for example by using cloud computing service providers;
- Processing such information to assist us with our business operations (e.g. to process payments and your deposits; authenticate your access; auditing our operations; detect and prevent fraudulent or illegal activity; etc.);
- Performing research, technical diagnostics or analytics;
- Communicating targeted advertising, as well as promotional and informational materials, in accordance with our marketing policy; and
- Whenever we believe in good faith that disclosure is necessary to protect our rights or legal claims, enforce our policies (including our User Agreement and this Policy), protect your safety or the safety of others, as well as to investigate or prevent any fraud, for security reasons or to help us with any other related technical issue.
Where we store and process information about you
Our Services, in whole or in part, may be hosted outside Ontario, Canada. Your Personal Information will be generally stored and used within the European Economic Area (EEA). For various operational and legal reasons, your Personal Information may be transferred to other foreign jurisdictions. This may include transfers of your Personal Information to third parties listed in Section 6.
By accepting this Policy, you consent to the transfer of your Personal Information to any jurisdiction in accordance with the Applicable Laws and accept that applicable data protection laws in those jurisdictions may differ from data protection laws in force in Ontario, Canada.
Whenever we transfer your Personal Information outside Ontario, Canada, we make sure that the Recipients of your Personal Information have policies and process in place to ensure that your Personal Information will be properly safeguarded at all times. We use contractual and other means to ensure that such Recipients provide a level of protection for your Personal Information that is adequate and equivalent to the level of protection set forth in this Policy and that are in line with the Applicable Laws to protect your Personal Information when it is transferred to foreign jurisdictions.
Where Personal Information is collected from you and processed in a foreign country, this information may be accessible to law enforcement and national security authorities of that jurisdiction.

Your rights
We will use reasonable efforts to keep your Personal Information accurate and up-to-date. You have the right to:
- To access or delete any Personal Information relating to you;
- To change or update any Personal Information relating to you (for example, if you believe that your Personal Information is incorrect). Note that you may also request that we will correct errors with regard to your Personal Information (except in cases where the information is required to be kept in its original format under any applicable laws and regulations);
- That we will restrict or cease any further use of your Personal Information;
- That we will provide the Personal Information (i) you volunteered to us by giving us explicit consent for processing or (ii) that has been used for the purpose of executing an agreement with You, in a machine-readable format;
- To object to the processing of your Personal Information (such as for marketing purposes);
- To withdraw your consent to our processing activities (provided that such processing activities rely on your consent, and not on a different legal basis);
- To not be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you, except where such processing is necessary for the performance of the contract between you and us, or it is based on your explicit consent, as provided hereunder.
Please note that these rights are not absolute and requests are subject to any applicable legal requirements, including gambling regulations and other legal and ethical reporting or document retention obligations. Please note that withdrawing your consent to the collection, use and disclosure of your Personal Information, and/or asking that we delete your Personal Information, may result in our being unable to continue to provide you with the Services. As well, please note that we may also rectify, replenish or remove incomplete or inaccurate information, at any time and at our own discretion, in accordance with our internal policies. You may exercise your right, as well as any other data subject rights that may be provided for by the Privacy Laws, by contacting us at support@tooniebet.ca. Please note that we may require you to provide sufficient proof of your identity before we can accommodate your request.
Information about minors
Our Services are to be used exclusively by persons of at least 19 years of age ("Legally of Age"). If you are not Legally of Age, you should not download or use the Services nor provide any Personal Information to us. We never knowingly or intentionally collect or use Personal Information of individuals below 19 years of age. We reserve the right to access and verify any Personal Information collected from you. In the event that we become aware that a user who is not Legally of Age has shared any information, we may discard such information unless it is needed to comply with any legal or statutory obligation binding upon us. You must immediately inform us (contact details are available under the "CONTACT US" section) if you are below 19 years of age, you are a parent or a guardian of such person, or you otherwise become aware of any person below 19 years of age whose Personal Information we process. After appropriate verification, we will delete such Personal Information.
Cookies and other technologies
We collect certain categories of Personal Information automatically by using cookies and similar technologies.
When you visit our Website or use our Services, a cookie will be stored on your computer. Generally, cookies and similar technologies work by placing a small text file to your browser and by assigning to your browser or device a unique number that has no meaning outside of our Services. We use these technologies to personalize your experience, including language and currency preferences. We also use these technologies to collect statistics about the usage of our Services, perform analytics and to assist in delivering content specific to your interests.
Additionally, after you’ve entered your login and password to access our Services, we save that information so you don’t have to re-enter it repeatedly during that session and may save your login for future sessions.

We are committed to providing you choices to manage your privacy and sharing however we do not recognize or respond to browser-initiated Do Not Track signals, as the internet industry has not fully developed Do Not Track standards, implementations and solutions.

Retention period
Non-Marketing purposes
Where we collected your Personal Information for non-marketing purposes, we will retain and process your Personal Information for as long as it is necessary to fulfill the purposes for which it was collected. Thereafter, it will be disposed of in accordance with our retention and disposition policy and schedule.
Please note that the Applicable Laws may require us to retain certain portions of your Personal Information after you have stopped using our Services, and we may also retain your Personal Data to resolve disputes and enforce our agreements with you or for other legitimate interests such as fraud prevention, responsible gaming reasons. We may also delete certain Personal Information as part of our record-keeping practices, provided we are not under a legal obligation to keep it, and we disclaim any liability that may arise from us deleting such Personal Information.
Marketing purposes
Where we collected your Personal Information for marketing purposes, we will retain and process such Personal Information until you ask us to stop such processing. Please note that we may require up to 72 hours to implement your request and stop such processing. We will also retain information that you have made such a request in order to comply with it in future.
Other websites and services
This Policy applies to our Services, save for those portions of the Services where you are offered to accept a different privacy policy to govern the collection and use of your personal information by those portions of the Services and it does not apply to any third party websites, services or applications, even if they are accessible, downloadable, or otherwise distributed through the Services.
Our Services may include links to third-party websites, applications or services. We are not in any way responsible or liable for the content of such third-party websites and services (including their treatment of your Personal Information). We suggest that you read the applicable policies of such third-party websites and services.
You knowingly and voluntarily assume all risks of using any third-party websites, services or applications. You agree that we shall have no liability whatsoever with respect to such third party sites and your usage of them.
Information security
Security of your Personal Information is important to us, and we use commercially reasonable efforts to prevent unauthorized disclosure of your Personal Information or other data breaches. We have adopted a secure Internet communication protocol TLS 1.2. This protocol involves encryption of your Personal Information during transmission over the internet. We store your Personal Information on encrypted hard drives to provide an additional layer of security. Our Services are hosted with website identification authorities so that your browser can confirm our identity before any personally identifiable information is sent. Our secure servers protect this information using advanced firewall technology. We also employ other technical and organizational measures to protect the availability, confidentiality, and integrity of your Personal Information and to prevent unauthorized access, according to the appropriate risk assessment.
Although we take reasonable steps and employ appropriate security measures to safeguard your Personal Information, the Internet is not completely secure. We advise you to follow these rules to reinforce the security of your Personal Information:
- Use strong passwords
- Always log out of our Services when you are not using them
- Do not share your account information with third parties
- Do not use your real name, date of birth or other Personal Information as part of your login or password
- When entering your credentials, double-check the address bar of your browser to make sure you do it on the intended website.
Please note, that no security measures are able to give an absolute guarantee against potential data breaches. Should any incident that materially impacts your Personal Information occur despite our measures and efforts, we will notify you, iGaming Ontario, and any other entity as may be required by the Applicable Laws, and we will aid iGaming Ontario and any related authorities in breach management and handling of any results from a breach and keep a record of any such privacy breach to the extent required by applicable laws.
Changes to this Policy
We reserve the right to amend this Policy at any time at our sole discretion, therefore please re-visit this page frequently. We will notify you of substantial changes to this policy, either by email or through the Website interface when you first access our services after the change. Such substantial changes will take effect fourteen (14) days after such notice was provided on any of the above-mentioned methods. Otherwise, all other changes to this Policy are effective as of the stated “Last Revised” date, and your continued use of the Services after the Last Revised date will constitute acceptance of, and agreement to be bound by, those changes. Any changes in activities that require your explicit consent will be notified to you and you will be required to explicitly accept changes and renew your consent, before being able to access our Services.

If you have a concern or complaint regarding this Policy, our privacy practices, or the treatment of your Personal Information, please submit it to us at support@tooniebet.ca or by following our regular complaint process available on the Website via Complaints Page.
We may require you to confirm your identity or provide additional details to be able to respond to your complaint. We will endeavor to respond to your complaint within reasonable time. In certain cases, we may require up to 10 business days after we receive all the required information to respond to your complaint.
